Plain English summary: You must be 13+ to play. Pro membership auto-renews unless you cancel. Be nice to other players. We can suspend accounts that cheat or harass others. Australian Consumer Law applies and we don't try to opt out of it. Disputes are heard in New South Wales, Australia.
By accessing or using Quantum Button (the "Game"), you agree to be bound by these Terms of Service (the "Terms") and our Privacy Policy. If you do not agree, please do not use the Game.
The Game is operated by Spencer the Gathering (sole trader), based in Australia ("we", "us", "our"). Our ABN will be added once registered.
Minimum age: 13. You must be at least 13 years old to use the Game. We ask for your year of birth at signup. If your year of birth indicates you may be under 13, you cannot create an account and cannot use the Game.
Under-16 restrictions. Users between 13 and 15 may use the Game with the following restrictions:
Misrepresenting your age is a breach of these Terms and grounds for immediate account termination. Where required by law, we will report illegal activity (including misrepresentation by adults to access content involving minors) to relevant authorities.
Quantum Button is a free-to-play browser-based reaction tap game available as a Progressive Web App. It includes optional paid features through a Pro subscription and a coin shop. We may modify, suspend, or discontinue any aspect of the Game at any time, in which case we will use reasonable efforts to notify users in advance where the change is material.
You may use the Game as a guest. To unlock cloud save, leaderboards, friends, and VS multiplayer, you must sign in with Google.
You are responsible for keeping your account secure. We are not liable for loss or damage from unauthorised access caused by your failure to protect your credentials.
Account suspension or termination: We may suspend or terminate accounts for breach of these Terms, including cheating, exploitation, harassment, or repeated reports validated by our review. We will give you notice and an opportunity to appeal where reasonably practicable, except where immediate action is required to protect other users or comply with law.
You may close your account at any time via Profile → Delete Account.
When using the Game, you agree NOT to:
Violations may result in score resets, item removal, temporary feature restrictions, or account termination depending on severity.
Pro membership tiers:
Cancellation: You can cancel a monthly or yearly subscription at any time via the RevenueCat customer portal accessed from Settings → Manage Subscription, or via your platform billing settings (Google Play, Apple App Store). Cancellation takes effect at the end of the current billing period — you keep Pro features until then. No partial-period refunds are issued, except where required by law.
Coin packs: Coins purchased with real money are credited to your account immediately on payment confirmation. Coins have no real-world value, are non-transferable, and are non-refundable except where required by law. Coin packs are not available in countries that prohibit them.
Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law (ACL) that cannot be lawfully excluded. To the extent permitted by law, our liability for breach of any non-excludable ACL guarantee is limited to (at our election) the resupply of services, the supply of equivalent services, or refund of the price paid.
Payments are processed by RevenueCat and Stripe (or your platform's billing system on mobile). We do not directly process refunds — refund requests should be directed to the original payment platform.
Coins, crates, gems, skins, and other in-game items ("Virtual Items") are licensed, not sold, to you. You acquire only a personal, non-transferable, revocable licence to use Virtual Items within the Game.
Virtual Items have no real-world value, cannot be exchanged for real money, and cannot be transferred to other accounts. We may modify, replace, or remove Virtual Items at any time. If your account is terminated for breach of these Terms, you forfeit any unused Virtual Items without refund, except where required by law.
Some crates and spin wheels in the Game award randomised rewards. The drop rate for each item in each crate type and rarity tier is published at loot-odds.html and is also linked from the in-game purchase UI.
Crates cannot be purchased directly with real money. Real money buys coins (or Pro membership); coins can then be spent on crates within the Game.
Where local law prohibits real-money randomised mechanics (currently Belgium and the Netherlands), coin-pack purchases are disabled. Pro membership remains available in those countries.
By setting a display name, choosing an avatar, creating a challenge, joining a duel, submitting a score, or otherwise providing content to the Game, you grant us a non-exclusive, worldwide, royalty-free licence to host, display, and transmit that content for the purpose of operating the Game. You retain ownership of your content.
Licence termination: The licence above ends when you delete your account, except that we may retain content already published to leaderboards or shared with other players in their archives until they themselves delete it.
For Australian users: to the extent permitted by law, you consent under the Copyright Act 1968 (Cth) to any act or omission by us in relation to your content that would otherwise infringe your moral rights, where such consent is necessary to operate the Game (for example, attribution as your display name rather than your real legal name).
All Game content — design, graphics, animations, sounds, music, code, logos, and text — is the intellectual property of Spencer the Gathering and is protected by copyright and trademark laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any Game content without our express written permission, except as permitted by these Terms for personal, non-commercial play.
The free version of the Game displays advertisements served by Google AdSense. By using the free version, you acknowledge that advertisements will be displayed. You may remove advertisements by subscribing to Pro. Advertisement content is provided by third-party networks; we do not control or endorse the content of individual advertisements.
Age requirement: Camera and video features require users to be 16 or older. The age band is set at signup and cannot be changed.
VS camera consent: When you enable the camera in a VS duel, your opponent will see your live video feed. By enabling the toggle, you accept that your face will be visible to another user. The video is peer-to-peer (WebRTC) and not recorded on our servers.
Recording consent: By enabling the Record toggle, you consent to the round being captured as a local file on your device. In VS mode, your opponent's avatar (not their live face) is included in the recording for privacy. You agree not to redistribute recordings of other players in a manner that violates their dignity or privacy.
Code of conduct: Camera and recording features must not be used to transmit nudity, sexual content, graphic violence, hate symbols, or illegal content. Violations result in escalating consequences from temporary restrictions to permanent termination.
Reports and blocking: If you encounter inappropriate behaviour, you may submit a report through the in-duel flag or post-duel results screen. Submitting a report adds the player to your personal block list. False or malicious reports may themselves result in account action.
Severe violations involving illegal content (including any material that sexualises minors) will be reported to relevant authorities including the Australian eSafety Commissioner where applicable.
To the maximum extent permitted by law, the Game is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Game will be uninterrupted, error-free, or free of harmful components. Nothing in this section excludes, restricts, or modifies any Australian Consumer Law guarantee that cannot be lawfully excluded.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Game, including loss of data, loss of profits, or loss of game progress.
For breaches that cannot be excluded under Australian Consumer Law, our maximum liability is limited (at our election) to the resupply of services, the supply of equivalent services, or refund of fees paid by you to us in the 12 months preceding the claim.
We may update these Terms from time to time. For material changes affecting your rights or obligations, we will provide at least 14 days' notice via the Game or push notification (if enabled). Your continued use after the notice period constitutes acceptance. If you do not agree to the changes, you may close your account before they take effect.
These Terms are governed by the laws of New South Wales, Australia.
Any disputes arising from these Terms or your use of the Game are subject to the non-exclusive jurisdiction of the courts of New South Wales, Australia. Nothing in this clause prevents you from bringing proceedings in any forum where you have a right to do so under applicable consumer protection legislation.
